A product seen in a TikTok video arrives looking different from the screen. TikTok Shop is a lawful marketplace; the answers below come from its UK and US pages read on 17 October 2026 and from official consumer bodies. Pages for other TikTok Shop countries were not reviewed. General information, not legal advice.
Who is the seller when a video leads to a purchase?
TikTok’s UK customer policy (dated 04/06/2026) says TikTok does not sell products on TikTok Shop and that the contract of sale is always solely between the buyer and the seller. A problem with the product goes to the seller through “Contact Seller”; a problem with TikTok Shop itself goes through “Contact Us”. The US Buyer Policy (last updated 12 August 2024) likewise says TikTok is not a party to the transaction and that sellers must make sure a product is fit for purpose and corresponds with its Product Detail Page description.
Do a video, an advert or a live sale change the rights?
For UK LIVE Bidding purchases, the policy says the change-of-mind cancellation right and extended returns still apply, except for listed exceptions and opened trading cards, although the Live Bidding terms take priority if they conflict. For adverts, the ASA takes complaints about an ad someone thinks is wrong and asks for a screenshot and details of where and when it was seen. In Ireland the CCPC says the Digital Services Act gives a right to complain to the platform about a misleading ad.
How long is there to return something in the UK?
The UK policy gives a statutory right to cancel within 14 days after receipt, plus an extended returns benefit of 30 days, subject to exceptions such as personalised goods and sealed hygiene products. The policy says such products cannot be returned for a change of mind but can be if defective. TikTok’s seller-facing UK policy (26/08/2026) says a return or refund request can be raised through TikTok Shop for up to and including 30 calendar days from delivery, and that sellers must respond within 2 working days. A returned item must be sent within 14 days of the request.
What counts as not as described, and who pays?
The seller-facing policy lists products “not as described in the Seller’s product listing”, counterfeit products and wrong specifications such as colour, shape or brand as physically different products. Returns are free for items that are faulty, damaged, wrong or do not match their description. The customer policy adds that sellers must meet legal requirements (including matching their description) and that legal remedies against the seller can outlast the cancellation period or extended window. In England, Citizens Advice lists rights for goods “not what was advertised”; see also counterfeit goods on online marketplaces.
What if the seller refuses?
If a seller says an item is not eligible, the buyer can ask TikTok Shop to review the decision through the Refund Details page within 10 days of the seller’s notice, or through the Help button on Order Details; TikTok states this does not limit legal rights. Before any bank claim, note that a chargeback request can affect eligibility for TikTok Shop US’s money-back guarantee; the UK policy read does not say how a card claim affects a TikTok claim, so ask first. For UK buyers, Citizens Advice explains Section 75 for credit cards (more than £100 up to £30,000 per item) and chargeback otherwise. See paying safely online.
What is different in the United States?
TikTok Shop US advertises free returns on most items for 30 days and a money-back guarantee of up to 90 days from “Delivered” for items that arrive damaged or defective once the return window has closed. Pre-owned, collectible and final-sale items are excluded from that guarantee (the page does not address other remedies), clear photographs are needed, a returned item must go back within 14 days, and eligibility requires that no chargeback has been requested. The FTC’s billing-error process asks for a letter reaching the issuer within 60 days of the first bill with the error (for example, things not delivered as agreed), but for a quality problem it says to contact the seller first, so 60 days is not the clock for every quality complaint.
Who else can be told, and in what order?
- In the first hour, photograph the item beside its packaging and label, and screenshot the video or listing, the order page and seller messages.
- Raise the request in the TikTok app under the order; the UK Cancellation and Returns Policy and the US money-back guarantee set out the steps.
- If fraud or exposed payment details are suspected, call the bank at once. For an ordinary order dispute, use TikTok Shop’s order process first. Requesting a chargeback can affect eligibility for the US money-back guarantee, so ask TikTok Shop and the card provider before opening a claim, and note both sets of deadlines. Ask about chargeback; UK buyers can also ask whether Section 75 applies (Citizens Advice guide).
- Report to the bodies below, use strong unshared passwords, and never pay anyone offering to recover money.
UK. Citizens Advice’s helpline for England and Wales is 0808 223 1133 (Monday to Friday, 9am to 5pm), listed on GOV.UK; it can refer complaints to Trading Standards. If fraud is suspected, Report Fraud is on 0300 123 2040. See where to report a scam in the UK.
Ireland. The CCPC helpline is +353 (0)1 402 5555.
United States. After checking the chargeback point above, use the FTC’s card dispute guide, then ReportFraud.ftc.gov and the state attorney general.
Canada and Australia. TikTok pages for these countries were not reviewed. The Competition Bureau takes complaints in Canada about false or misleading representations, and scams go to the Canadian Anti-Fraud Centre (1-888-495-8501). In Australia, the ACCC accepts reports but does not resolve individual disputes, and scams go to Scamwatch.
The bottom line
Report quickly through the order page, keep evidence, and remember the UK 14-day statutory and 30-day windows and the US 30-day and 90-day windows differ; the 30-day and 90-day figures are platform windows, not the limit of legal rights. UK LIVE Bidding items follow the same change-of-mind windows, with listed exceptions and the Live Bidding terms taking priority.
